Bet-au.com AFL Tipping Hero Competition Terms and Conditions
1. Parties
1.1. Bet-au.com AFL Tipping Hero Terms and Conditions for an agreement between Bet-au.com, part of the Brave Planet Ltd Media Group of websites, registered in England (08339469) and referred to hereafter as “the Company” and entering participants hereafter referred to as “Players” and individually as “Player”.
2. General
2.1. By entering into this Competition Players acknowledge and accept to be deemed to have read and understood these Terms and Conditions (the “Conditions”). Players not complying with these Conditions are ineligible to compete and the Company reserves its absolute right to disqualify any such Player from the Competition.
2.2. Entry into the Competition shall be free of charge.
2.3. In these Conditions, the following words and phrases have the following meanings:
“Player” means a person who is eligible to participate in the Competition;
“AFL” means the series of Matches of –Australian Rules Football conducted by the Australian Football League (AFL) between member teams of the AFL over the AFL Season;
“Competition” means Player AFL Tipping Hero Competition whereby winning entries are based on the Results of Matches at the conclusion of the AFL’s Rounds and Home and Away Season;
“Season” means the 2015 season of the AFL including Home and Away rounds inclusive;
“Round” means a round of matches of the AFL conducted during the AFL Season;
“Home and Away Season” means a number of rounds of which Matches are played between member teams of the AFL –Australian Rules Football (AFL) consists of 23 rounds over the AFL Home and Away Season;
“Match” means a single game, of and conducted by the AFL, between member teams of the AFL;
“Tipping Dollars” means the allocation of ‘points’ to a Player for the correct selection of winning teams, Tipping Dollars are calculated based on a notional $1.00 bet on the Result of each Game multiplied by the Odds displayed on the Entry Form.
“League Ranking” means the position a Player is ranked on a Public League tables for the Competition;
“Away Team” means the team that is listed by the AFL as playing away from their home ground. If the AFL does not nominate an Away Team, the Away Team will be nominated at the discretion of Bet-au.com
“Prizes” means the weekly prizes on offer
“Results” are the results of Matches as officially determined by the AFL in accordance with the rules of the AFL following the completion of a Round;
“Web Site Server” is the server on which the Bet-Au.com website and AFL Tipping Hero Competition is hosted
“Sponsor” is any betting company who sponsors the competition and who provide the prizes, the the case of the 2015 AFL Tipping Hero competition, William Hill.
2.4. Entry into the Competition is available between 20/02/2015 and 01/09/2015 for the AFL;
3. Player’s obligations
3.1. To enter the Competition, a Player must:
a. register for the Competition by registering their details via the on-line registration form on the Bet-au.com website;
b. for each Round, make a full selection of the predicted outcomes of each of that Round’s matches;
c. a draw cannot be selected as a Match result selection.
d. complete the tie breaker for total points scored in our selected tie break match
3.2. Only one registration in the Competition per Player is permitted and any Player with more than one Registration shall be disqualified from the Competition.
3.3. In the event of a Match in a given Round being drawn, cancelled, abandoned, not completed or not played for any reason and/or a Result or rescheduled date is not officially declared within thirty (30) days of the date the Match was originally scheduled to be played, it shall be treated as a win for both teams competing in that Match.
3.4. Already submitted selections may not be changed or cancelled.
3.5. If a Player does not submit an entry for a given Round, no Tipping Dollars shall be awarded for that Round.
3.6. In the event of 2 Players tying with the same amount of Tipping Dollars in any prize position in a league table, the prize will be determined by a tie breaker, based on the closest (rounded up) prediction as to the total game points in a specially selected game. In the event of the players both still being tied, they will share the sum of the prizes in their positions.
3.7. End of season place winners will be determined on 10/09/2015 for the AFL.
4. Company’s liability
4.1. The Company and the partners agencies associated with this Competition shall not be liable and do not accept responsibility for:
a. Player’s tips that are not received by the Company or which are received and subsequently corrupted or rejected by the Web Site Server. This explicitly includes any private or public tipping competition which use or solely rely on the Bet-au.com website as a means for collection and disbursement of data to their own players;
b. any lost, misdirected or corrupt emails to or from the Web Site Server;
c. any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with a Player’s participation in the Competition or the taking of a place, except that which cannot be excluded by law; and
d. relating to the conduct of the Competition however caused, including failure of the Bet-au.com website or incorrect or corrupt data supplied by Players to the Bet-au.com website;
e. The Company will not be held responsible for any loss of reputation, status or otherwise in connection with a Player’s tipping selections and consequential results.
5. Players’ Information
5.1. Information about Players is used by the Company to assess and process registration in the Competition. All entries become the property of the Company and will be entered into a database. Information emanating from the Player’s participation in the Competition is used by the Company and its agencies associated with this Competition for the determination of winners and distribution of prizes, if any, awarded to a Player. By entering into the Competition, Players consent to publishing their name or alias and accumulated winning team points on the Bet-au.com website. Information about Players may also be used by the Company, its agents, assignees, contractors and related companies, for the purposes of carrying out marketing, planning, product development and direct mail and promotional campaigns unless a Player otherwise withdraws their consent to the use of their information in this manner. Players must inform the Company in writing of their wish to be withdraw consent.
5.2. Notwithstanding the Company’s rights under condition 7 to not accept or to subsequently disqualify a Player from the Competition, the Company will not be liable for any legal action arising out of any user name being slanderous, defamatory or unsightly to the public at large or any similarly sounding or related group and any Player user name which is subsequently found to be slanderous, defamatory or unsightly in any way will indemnify the Company, its agents, assignees, contractors and related companies from any legal action, claim or dispute arising in relation thereto.
6. Disputes
6.1. In the event there is a dispute or issue concerning or in any way arising out of or in relation to any aspect of the conduct, management or determination about the Competition, the decision of the Company is final and no correspondence will be entered into.
7. Miscellaneous
7.1. In the event of any unclaimed prizes within three months, the prize will be allocated to the 2nd place winner or the third place winner if the 2nd place winner is not available, and so on.
7.2. Any tax liability arising as a result of accepting any prize is the sole responsibility of the winner.
7.3. The Company reserves the right to change, add or alter any of the terms and conditions (including prizes) if in the absolute opinion of the Company it is in the interest of the Competition and such change shall be notified to the Players by being placed on Bet-au.com Website and each Player shall be bound by such change, addition or alteration to the Conditions.
7.4. The Sponsor offers the prizes in the form of Free Bets, terms and conditions for the Free Bets is available on request from the sponsor, but are the standard free bet rules applied to all free bets offered by the sponsor. 8. Applicable Law and Enforceability
8.1. If any provision of these Conditions is held by a competent authority to be invalid or unenforceable, the remaining provisions of these Conditions will not be affected and will remain valid.
8.2. Players agree that these Conditions and any dispute arising out of or in relation to the Competition shall be governed by and construed in accordance with the UK law, without regard to its conflict of law provisions.
